Terms of Service

1. Introduction & Acceptance
Welcome to IndTender ("Service"), operated by Xspark LLP ("Company", "we", "our", "us"). IndTender provides AI-powered government tender alerts via WhatsApp to registered Indian businesses.
By registering for an account, using our WhatsApp service, or accessing our website at indtender.in, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.
2. Eligibility
To use IndTender, you must:
- Be a registered Indian business entity (proprietorship, partnership, LLP, company, trust, society, or individual trader)
- Have a valid WhatsApp-enabled mobile number with country code +91 (India)
- Be at least 18 years of age
- Provide accurate company name, business category, and contact information during onboarding
IndTender is a B2B (business-to-business) service. Individual consumers not engaged in business are not eligible.
3. Account Registration
Registration is done via WhatsApp or our web onboarding form. You agree to:
- Provide accurate and complete business information
- Keep your registered WhatsApp number active and accessible
- Notify us if your business details (company name, contact) change
- Not share your account with third parties outside your business
We reserve the right to reject, suspend, or terminate any account that provides false information or violates these Terms.
4. Subscription Plans & Billing
IndTender offers the following subscription tiers (prices exclusive of 18% GST):
- 7-Day Free Trial: Full service access at no cost for 7 days. No credit card required.
- GeM Starter (₹499/month or ₹3,999/year): GeM portal alerts only, up to 10 keywords.
- Northeast Pro (₹1,299/month or ₹9,999/year): GeM + all 8 Northeast state portals, up to 25 keywords.
- All India Elite (₹2,999/month or ₹24,999/year): GeM + all states + Central Govt + Railways, unlimited keywords.
Subscriptions auto-renew at the end of each billing period. You will be notified via WhatsApp before renewal. Payment is processed via PhonePe, Razorpay, or other authorized payment gateways. UPI payments are preferred and have zero extra charges.
If a payment fails, your service will be paused. We will send a WhatsApp reminder. Service resumes upon successful payment.
5. Service Description & Limitations
IndTender scrapes publicly available government tender portals (GeM, NIC GePNIC state portals, CPPP, IREPS) and sends matching alerts via WhatsApp. By its nature, this service has inherent limitations:
- Not exhaustive: We do not guarantee that every tender on every portal will be captured. Government portals may have downtime, CAPTCHA restrictions, or structural changes.
- Not real-time: Alerts are sent once daily, typically between 7–9 AM IST. Tenders published after our daily scan will appear the next day.
- AI matching is approximate: Our AI keyword matching is designed to be helpful, not perfect. Some irrelevant tenders may occasionally be included; some relevant ones may be missed.
- Uptime: We target 95% monthly uptime for the alert service. Scheduled maintenance will be communicated in advance.
- Portal availability: State and central government portals may be temporarily unavailable. We are not responsible for downtime of third-party government websites.
IndTender does not submit tenders on your behalf, provide legal tender advice, or guarantee any business outcome from tender alerts received.
6. Acceptable Use
You agree NOT to:
- Use IndTender for any illegal purpose or in violation of Indian law
- Resell, redistribute, or re-publish tender data received via IndTender
- Attempt to scrape, reverse-engineer, or automate access to our WhatsApp bot
- Submit multiple accounts for the same business to abuse free trials
- Use IndTender to gain competitive intelligence on competitors' bids (for which TenderDekho-style services exist)
- Impersonate another business or provide false registration details
7. Intellectual Property
All content, branding, logos (including "Hori" the Hornbill mascot), software, and systems of IndTender are the intellectual property of Xspark LLP. You receive a limited, non-exclusive, non-transferable license to use the Service for your business purposes during your subscription period.
Tender data sourced from government portals remains the property of the respective government bodies and is subject to their terms.
8. Privacy
Your use of IndTender is governed by our Privacy Policy, which is incorporated into these Terms by reference.
9. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ALL GOVERNMENT TENDERS WILL BE CAPTURED.
USE OF TENDER INFORMATION FOR ACTUAL BID SUBMISSION IS AT YOUR OWN RISK. ALWAYS VERIFY TENDER DETAILS DIRECTLY ON THE OFFICIAL GOVERNMENT PORTAL BEFORE BIDDING.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE INDIAN LAW, XSPARK LLP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF INDTENDER, INCLUDING BUT NOT LIMITED TO LOST BUSINESS, MISSED TENDERS, OR FAILED BIDS.
Our total liability to you for any claim shall not exceed the subscription amount paid by you in the three (3) months preceding the claim.
11. Termination
You may cancel your subscription at any time by messaging "CANCEL" on WhatsApp or emailing xsparkllp@gmail.com. Cancellation takes effect at the end of your current billing period.
We may terminate or suspend your account immediately if you violate these Terms, engage in fraudulent activity, or abuse the free trial system.
12. Changes to Terms
We may update these Terms periodically. Material changes will be communicated via WhatsApp at least 7 days before taking effect. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of courts in Guwahati, Assam, India.
We encourage resolving disputes amicably. Before initiating any legal proceeding, please contact us at xsparkllp@gmail.com to seek resolution.
